1. Provider
These Terms of Service govern your use of the website operated by Atrium Arts (the "Service"). For provider details and contact information please see our Impressum.
2. Scope of the service
Atrium Arts is an online platform for visual artists. We offer artist profiles, artwork showcases, exhibition listings, gigs/open calls, and paid subscription plans (Basic, Medium, Pro) that allow artists to submit a defined number of artworks per billing cycle.
3. Accounts
To submit artworks or apply to exhibitions you must register an account and keep your credentials confidential. You are responsible for activity that occurs under your account.
4. Submissions and intellectual property
- You retain copyright in any artwork or content you upload.
- By uploading, you grant Atrium Arts a non-exclusive, worldwide, royalty-free licence to host, display, and promote your content within the Service and in associated marketing materials.
- You warrant that you are the rights holder or have the necessary permissions for everything you upload.
5. Subscriptions and payments
Paid plans renew on a monthly or annual basis depending on the plan selected. Payments are processed by PayPal or Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing cycle.
6. Right of withdrawal (EU consumers)
Consumers resident in the EU have a 14-day right of withdrawal under Directive 2011/83/EU. By starting a digital service before the end of the withdrawal period you expressly consent to immediate performance and acknowledge that the right of withdrawal lapses upon full performance.
7. Acceptable use
You agree not to upload illegal, infringing, defamatory, hateful, or sexually explicit material, and not to interfere with the technical operation of the Service. We may suspend or terminate accounts that breach these rules.
8. Liability
To the maximum extent permitted by law, Atrium Arts is liable only for damages caused by intent or gross negligence. Liability for slight negligence is limited to the breach of essential contractual duties and to foreseeable, contract-typical damages. Mandatory statutory liability remains unaffected.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or via a notice on the site at least 30 days before they take effect.
10. Governing law and venue
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the user's country of residence remain unaffected.
